ClearPath TMS LLC ("ClearPath","we","us") provides logistics software including a web-based transport management system and its companion mobile apps, collectively called ClearPath TMS, and a load exchange network called Plateau™. We will refer to these collectively as the "ClearPath Software".

Privacy Policy

We are committed to protecting the privacy of our registered customers ("Customer","you","your") who use ClearPath Software, as well as non-registered visitors to our public websites, https://www.clearpathtms.com and https://www.joinplateau.com ("Visitors"). This Privacy Policy explains how we handle your Personally Identifiable Information ("PII", "PII Data") as well as the PII Data of others that you store in the ClearPath Software.

Our privacy policy may be updated from time to time. When a change is made to our privacy policy, we will post a notice on www.clearpathtms.com and www.joinplateau.com.

Definition of Personally identifiable information ("PII")

PII is defined as any representation of information that permits the identity of an individual to whom the information applies to be reasonably inferred by either direct or indirect means. Further, PII is defined as information: (i) that directly identifies an individual (e.g., name, address, social security number or other identifying number or code, telephone number, email address, etc.) or (ii) by which an agency intends to identify specific individuals in conjunction with other data elements, i.e., indirect identification. Additionally, information permitting the physical or online contacting of a specific individual is the same as personally identifiable information. This information can be maintained in either paper, digital or other media.

Definition of Customer Data

Customer Data is the information, data, and other content, in any form or medium, that is submitted or otherwise transmitted by or on behalf of Customer in the course of registering for and using the ClearPath Software.

Definition of Aggregated Statistics

Aggregated Statistics is the anonymized and aggregated data derived, at least in part, from the data and information related to Customer's use of the ClearPath Software for ClearPath’s own business purposes, including without limitation the compiled statistical and performance information related to its provision and operation of the ClearPath Software.

How We Collect PII Data

Some PII data is knowingly provided by Customers and website visitors. For example, customers will provide a name, address, and email when they register for Plateau or fill out a contact form inquiring about ClearPath TMS. Customers may store PII Data in their Customer Data about their employees, customers, and contacts as is necessary for the functionality of the ClearPath Software.

We also collect PII automatically. We collect IP information and cookies from our website Visitors and Customers to ensure that the ClearPath Software and our websites are functioning efficiently. We use this data as part of our Aggregated Statistics and occasionally an authorized ClearPath staffmember will use PII Data to identify a specific issue affecting a website Visitor or Customer. You can choose to decline cookies while visiting our websites, however, this may limit your ability to access certain areas of the websites. Most browsers accept and maintain cookies by default. Check the "Help" menu of your browser to learn how to change your cookie preference.

How We Handle PII Data

We understand that the loss of PII can result in substantial harm to individuals, including identity theft or other fraudulent use of the information. Unfortunately, no data transmission over the Internet can be guaranteed to be absolutely secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information transmitted over the Internet. Once we receive your information, we take steps that we believe are reasonably appropriate to protect its security, both internally and externally, from loss, misuse, unauthorized access, disclosure, alteration or destruction, and to ensure the integrity of the data we collect. We use a combination of technological, physical and administrative procedures we deem appropriate to protect this data.

The following requirements apply to PII in paper records, digital records and in oral communications, as well as any aggregation of PII in digital format (e.g., databases, webpages, e-mail and other communications software, spreadsheets, and file sharing services):

  • General - In addition to complying with all applicable legal requirements, ClearPath further limits the collection, use, disclosure, transmission, storage and/or disposal of PII to that which fulfills the mission of the ClearPath Software.
  • Safeguards - To protect PII against inappropriate access, use, disclosure, or transmission, ClearPath employs appropriate administrative, technical and physical safeguards. Examples of physical safeguards include storing documents containing PII in secured cabinets or rooms and ensuring that documents containing PII are not left on desks or in other locations that may be visible to individuals not authorized to access the PII.
  • Permitted Use Within ClearPath Software - Only individuals authorized by our Customers can access, use, transmit, handle or receive Customer Data, including any PII data contained therein.
  • Oral Communications - Only our authorized representatives may engage in oral communications involving PII. All oral communications involving PII may not take place in any location where the communication may be overheard by an individual not authorized to access the PII.
  • Storage and Transmission of PII - PII is only stored and transmitted as necessary using a strict information policy. Some elements of this information policy include encryption of passwords, housing of all servers in a secure data center behind a firewall, limiting access of data to appropriate engineers, and obfuscating PII data when transmitting between the mobile app, browser, and our servers.
  • Disposal - All PII is destroyed and rendered unreadable prior to disposal. This may include shredding papers and deleting data along with all copies.

How We Share Your PII Data

We will never sell or rent your PII to anyone. We will only share your PII Data in a limited set of circumstances as described below:

  • Third Party Services - We work with third party business as directed by our customers and will share limited PII as is necessary for those third parties to perform their services. For example, you may connect ClearPath TMS with QuickBooks for accounting features, or PC Miler for routing intelligence, download one of our mobile applications from the Apple or Google app store, or request one of our affiliates, such as SuperDispatch, to provide mobile EPOD services when registering for Plateau. We have no control over the policies and practices of third party Services in regards to privacy. If you choose to allow the automatic transmissions discussed above, please review all third party Services policies before engaging in such automatic transmissions on the Service.
  • Supplemental Information - We may use sources outside ClearPath to supplement the information you give us. For example, we may validate your address using other sources. We use this data to help us maintain accuracy and provide you with better service.
  • Business Transfers - Should we sell, merge or transfer any part of our business, part of the sale may include your personal information. If so, you will have the opportunity to ask not to receive promotional information following any change of control.
  • Protection of Company and Others - We may release Personal Information to comply with the order of a court or other governmental body, or as otherwise necessary to comply with applicable law, and exchange information with other companies to protect against fraud. We may also release PII if we feel it is necessary to establish our rights under other Agreements, including to make required court filings.
  • With Your Consent - Other than the scenarios described above, you will be notified when your Personal Information is shared with third parties, and you will be able to prevent the sharing of this information.
